Welcome to the website of Raw Glass Inc. (“Raw Glass,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of rawglass.ca, as well as all quote requests, blueprint submissions, field services, and orders placed with our facility in Carleton Place, Ontario.

By accessing our website, requesting a commercial quote, scheduling site services, submitting project drawings, or placing an order, you (“Buyer,” “Client,” or “User”) agree to be bound by these Terms. If you do not agree, you must refrain from using this website or submitting procurement requests.

1. Scope of Business & Service Options

Raw Glass Inc. provides custom architectural glass fabrication, wholesale distribution, and professional site services. Orders are executed under one of two operating scopes:

• Full-Service Orders (Measurement & Installation): Where Raw Glass Inc. is explicitly contracted in writing to perform site measurements and field installations, our technicians assume responsibility for field verification, layout fitting, and execution according to agreed contract specifications.
• Supply-Only Orders: Where products are purchased on a “supply-only” basis, Raw Glass Inc. acts strictly as the fabricator and supplier. The Buyer or their third-party contractor assumes sole responsibility for field measurement, site preparation, handling, and proper installation in compliance with applicable building codes.

2. Quotes, Blueprints & Custom Fabrication Orders

A. Customer Specifications & Blueprint Intake (Supply-Only)

For supply-only orders, quotes are generated based on dimensions, CAD files, DWG drawings, or written specifications provided directly by the Buyer.

• Buyer Responsibility: The Buyer is solely responsible for ensuring the accuracy of all measurements, tolerances, hole placements, cutouts, and technical glass specifications submitted to Raw Glass Inc.
• Non-Refundable Custom Orders: Because custom-cut, laminated, tempered, or specialized fire-rated glass is manufactured specifically to individual project requirements, custom orders cannot be cancelled, returned, modified, or refunded once fabrication or cutting has commenced.

B. Quotation Validity & Pricing

Prices quoted on our website, via email, or by estimation staff are in Canadian Dollars (CAD) unless otherwise stated. Quotes remain valid for thirty (30) days from the date of issue and are subject to verification of final project shop drawings, site conditions (for installations), and raw material availability.

3. Product Standards & Building Code Compliance

• Quality Standards: All glass products fabricated, distributed, or installed by Raw Glass Inc. are manufactured to meet applicable Canadian architectural safety glass standards (including CGSB and CAN/ULC standards for fire-rated assemblies).
• Code Suitability: It is the responsibility of the Buyer, architect, or glazing contractor to verify that the specified glass product (e.g., fire rating duration, laminate thickness, impact rating) satisfies local municipal, provincial, and national building codes for its intended application.

4. Delivery, Receiving & Inspection Requirements

A. Delivery & Receiving

Delivery times provided by Raw Glass Inc. are estimates. While we maintain efficient logistics across the Ottawa Valley, Raw Glass Inc. shall not be held liable for project delays caused by freight carriers, traffic, adverse weather, or supply chain disruptions beyond our reasonable control.

B. Mandatory Freight & Damage Inspection (Supply-Only Orders)

Glass is a fragile building material requiring immediate verification upon arrival:

• Inspection Window: For supply-only orders, the Buyer or their authorized job-site representative must inspect all shipments immediately upon receipt or job-site drop.
• Claims Protocol: Any claims for transit damage, chips, cracks, shortages, or dimensional variances must be noted on the carrier’s Bill of Lading and reported in writing to Raw Glass Inc. within forty-eight (48) hours of delivery.
• Waiver: Failure to report defects or damages within forty-eight (48) hours constitutes full acceptance of the shipment as-is. Raw Glass Inc. will not accept damage claims once supply-only glass has been handled, moved, or installed by third parties.

5. Intellectual Property & Site Content

A. Outbound Website Content

All text, visual layouts, graphics, branding, images, and technical content displayed on rawglass.ca are the exclusive intellectual property of Raw Glass Inc. or its brand licensors (e.g., SCHOTT AG) and are protected under Canadian and international copyright and trademark laws. You may not copy, scrape, reproduce, or redistribute site content for commercial purposes without our express written consent.

B. User-Submitted Blueprints & Project Images

By uploading project blueprints, CAD files, shop drawings, or site images through our contact or estimation forms, you grant Raw Glass Inc. a non-exclusive, royalty-free license to use, review, and store those materials strictly for estimation, fabrication, installation planning, and order processing. You warrant that you own or possess the legal right to share any submitted technical files.

6. Limitation of Liability & Warranty Terms

To the maximum extent permitted by applicable laws in Ontario and Canada:

• Supply-Only Warranty Exclusions: For supply-only orders, Raw Glass Inc. explicitly disclaims any liability for glass breakage, failure, seal degradation, structural issues, or thermal stress resulting from improper third-party field measurements, poor site storage, thermal stress, building settlement, or faulty installation by external contractors.
• Installation Warranty: For full-service measurement and installation orders performed directly by Raw Glass Inc. technicians, work is warranted against installation defects as specified in your individual scope of work or project contract agreement.
• Direct Remedy Cap: In the event of a proven manufacturing or fabrication defect acknowledged in writing by Raw Glass Inc., our sole liability shall be limited to either replacing the defective glass unit or refunding the purchase price of the affected glass panel.
• Exclusion of Consequential Damages: Raw Glass Inc. shall not be liable for any indirect, special, incidental, or consequential damages—including but not limited to job-site downtime, crane rentals, third-party labor costs, liquidated damages, or loss of business profits.

7. Website Use & Security

When using rawglass.ca, you agree not to:

• Use the site for any unlawful, fraudulent, or malicious purpose.
• Introduce malware, spyware, worms, or destructive digital code.
• Attempt automated data harvesting, web scraping, or unauthorized access to our estimating servers or submission portals.

8. Governing Law & Jurisdiction

These Terms, and any dispute, procurement order, or service agreement arising under them, shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts located in the Province of Ontario.
